1. Introduction
Welcome to NetStaff ("we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms and all applicable laws and regulations of the Republic of South Africa.
2. Definitions
In these Terms:
- "Services" means the staffing and recruitment services provided through our platform;
- "User" means any person who accesses or uses our Services, including both job seekers and employers;
- "Account" means the account created by a User to access our Services;
- "Personal Information" has the meaning assigned to it in the Protection of Personal Information Act, 2013 (POPIA).
3. Acceptance of Terms
By registering for an Account or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.
4. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts under South African law to use our Services. By using our Services, you represent and warrant that you meet these requirements.
5. User Accounts
5.1 Registration
To access certain features of our Services, you must register for an Account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
5.2 Account Security
You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account.
5.3 Account Termination
We reserve the right to suspend or terminate your Account at any time, with or without notice, if we believe you have violated these Terms or engaged in fraudulent or illegal activity.
6. Use of Services
6.1 Job Seekers
Job seekers may create profiles, upload CVs, and apply for positions. You warrant that all information provided is accurate and that you have the right to work in South Africa or as otherwise specified in job postings.
6.2 Employers
Employers may post job listings and review candidate profiles. You warrant that all job postings comply with South African employment laws, including the Employment Equity Act, 1998, and the Labour Relations Act, 1995.
6.3 Prohibited Uses
You agree not to use our Services to:
- Post false, misleading, or discriminatory content;
- Violate any applicable laws or regulations;
- Infringe on intellectual property rights;
- Transmit viruses, malware, or harmful code;
- Harass, abuse, or harm other Users;
- Collect personal information without consent;
- Engage in any form of automated data collection or scraping.
7. Intellectual Property
All content on our platform, including text, graphics, logos, software, and design, is the property of NetStaff or its licensors and is protected by South African and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.
8. Privacy and Data Protection
We process Personal Information in accordance with the Protection of Personal Information Act, 2013 (POPIA). By using our Services, you consent to the collection, use, and disclosure of your Personal Information as described in our Privacy Policy.
9. Fees and Payment
Certain Services may require payment of fees. All fees are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable. Payment terms will be communicated at the time of service selection.
10. Limitation of Liability
To the maximum extent permitted by South African law:
- We do not guarantee the accuracy, completeness, or reliability of any content or information on our platform;
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our Services;
- Our total liability for any claim arising from these Terms or your use of our Services shall not exceed the amount paid by you to us in the 12 months preceding the claim;
- We are not responsible for employment decisions made by employers or the quality of candidates.
11. Indemnification
You agree to indemnify and hold harmless NetStaff, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms or your use of our Services.
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
12.2 Mediation
Before initiating legal proceedings, parties agree to attempt to resolve disputes through mediation in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
13. Consumer Protection
Nothing in these Terms is intended to limit any rights you may have under the Consumer Protection Act, 2008. If any provision of these Terms is found to be in conflict with the Consumer Protection Act, the Act shall prevail.
14. Electronic Communications and Transactions
These Terms comply with the Electronic Communications and Transactions Act, 2002 (ECTA). By using our Services, you consent to receive electronic communications from us, and you agree that such communications satisfy any legal requirement for written communication.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify Users of material changes by email or through a notice on our website. Your continued use of our Services after such modifications constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
